What Property Is Included in the Sale of a Home? James H. Graff 732.500.6883

When selling your home, what items are legally included or excluded from the sale?      https://JGraff.AdvisorsMortgage.com  (My audiobooks are coming soon to Audible.com...Please stay tuned! eBooks available now-please,see below...)    In the simplest terms, home fixtures are included. If it's nailed down it comes with the house. A fixture refers to anything permanently attached or fixed to the property.

Items not permanently attached are considered personal property. Personal property is excluded from the sale because it can easily be removed without damaging the property.

Items considered fixtures would be things like chandeliers, ceiling fans, built-in bookcases, and built-in appliances. Window treatments such as blinds and attached curtains or drapes also generally stay with the home. Water softeners and security systems are also included but if they are being rented this should be disclosed by the seller.

If you want to exclude any fixtures, it's best to remove or replace them prior to putting your home on the market. If you don't specifically include them in the contract, they'll be automatically included in the sale.

When you're living in your home it's easy to overlook certain things because you see them everyday but when you're getting ready to sell your home it's important to look at things through the eyes of potential buyers and to make sure you're addressing anything that might turn them off. Is Housing Slowing?

For example, the Mortgage Bankers Association released their mortgage application data showing that mortgage applications to purchase a home fell 5% last week.


They assume the reason for this is a slowing housing market. Meanwhile, homes have appreciated by 14% over the last year due to more demand than available supply. This underscores the strength in the housing market.


The likely reasons for the drop in mortgage applications are because inventory is very low and because there is a significant increase in cash buyers. These cash buyers are not reflected in the mortgage application data because they do not need a mortgage.

Homes that need work can be great investments, especially if you can purchase them below market price. But stay away from upgrades that won't add value to the home. 

If a home needs major repairs to its plumbing, electrical, foundation, or roof, keep in mind that fixing major flaws can really eat up your renovation budget and these types of renovations hardly ever raise the value of the home enough to offset the cost.

According to Page, he wrote the music "over a long period, the first part coming at Bron-Yr-Aur one night".[9] Page always kept a cassette recorder around, and the idea for "Stairway to Heaven" came together from bits of taped music.[10] The first attempts at lyrics, written by Robert Plant next to an evening log fire at Headley Grange, were partly spontaneously improvised and Page claimed, "a huge percentage of the lyrics were written there and then".[10] Jimmy Page was strumming the chords, and Robert Plant had a pencil and paper. The complete studio recording was released on Led Zeppelin IV in November 1971. The band's record label, Atlantic Records, wanted to issue it as a single, but the band's manager Peter Grant refused requests to do so in both 1972 and 1973. This led many people to buy the fourth album as if it were the single. Spirit copyright infringement lawsuit Page's opening acoustic guitar arpeggios bear a resemblance to the 1968 instrumental "Taurus" by the Los Angeles-based rock band Spirit, written by Spirit guitarist Randy California.[9][33] In the liner notes to the 1996 reissue of Spirit's self-titled debut album, California wrote: "People always ask me why 'Stairway to Heaven' sounds exactly like 'Taurus,' which was released two years earlier.
